I'm OPPOSED to the proposed rule to increase the odds to 47.7 million-to-one and the play style (5/44 & 1/44 - 88 balls total) because it makes winning the top prize harder to win. I play to WIN the jackpot.

I am FOR the proposed rule because I want to see fewer jackpot winners so
the jackpots can climb.

Check IF this is what you think and believe.
I believe this style of play is discriminatory towards the consumer - it increases complexity of play and only serves to increase the unclaimed prize fund.

- Feb. 25, 2003 -
VIP - Our plans for protesting in Austin tomorrow, Feb 26, are cancelled
due to unsafe travel conditions. (Lot's of ice everywhere!) I regret this
more than you'll ever know but there is nothing I can do about it. I'm also
sorry that so many of you lost money due to hotels not giving you refunds
and lost vacation days when most of you could have gotten the
day off without losing vacation time.

I've tried contacting each one of you individually but I didn't
reach some, so ... I'm hoping you will see this message
and NOT go to Austin as planned. Even the TLC is closed
because of the weather. I understand the TLC is still planning
to have a comment hearing in spite of the weather but they are
also going to set another date for another hearing.

Many thanks to all of you who worked so hard to pull this off.
I think we're all disappointed - especially me. Be careful,
be safe and God bless you all for your tremendous efforts.

2nd - After you've commented, here is what needs to be

3rd - Petitions - Zerox multiple copies. Take to work, take to
business meetings where lots of people are, take to your
retailer and ask him to let his customers sign it. Each of you
should be able to get 50 to 100 signatures easily. What I'd do is after
I got a bunch of signatures is, I'd fax a copy to the Governor and
my legislators. Since ya'll are from everywhere, the more opposition
they see, the more prone they are to make calls to the Commissioners
to halt this thing. The Commissioners work for the legislators.
(I'm doing my job, now you have to do yours if you want us to succeed.)

Update - Feb 13, 2003 - Regarding commenting - Why have we waited
to comment?
There are 2 excellent reasons. First and foremost, the rule
states, "Comments must be received within 30 days after publication
of the proposed rule in the Texas Register to be considered.
"

The proposed rule won't appear in the Texas Register until Feb 14, 2003
which means that whatever the TLC receives before that date, can be
thrown out legally. Don't laugh. In May 2001, they proposed a new
rule but received many comments of opposition.

So, they withdrew the rule. Then, they re-proposed the same basic thing but
with a clean slate - meaning no comments of opposition had ever been received.

Had it not been for my letters to the Governor and several key legislators,
the TLC would have gotten away with this "legal" manuever. Fortunately for us,
Ms. Kiplin & Ms. Cloud were forced to acknowledge the comments they had
already received and in the end, we WERE heard and we DID win.

FYI - Right now they are sending replies to those that have already
commented telling players that the official comment period begins
when the rule is posted in the Texas Register and they must receive
the comments ONLY by fax or US mail.

The second reason, I needed to read the proposed rule and I didn't even
get it until Jan 31st. We had to know what it said so we would know
what issues we needed to address in our comments and when to comment.

I have provided you with a very easy way to comment and the reasons why it must
be done in this way. If you want to stop the TLC from making the top prize in
Lotto Texas harder to win,
then please follow my advice. I honestly believe we
CAN stop them even though they are desperate. But I can't do it without your help.

Update - Feb 7, 2003 - Regarding commenting - The TLC, in a recorded
message intended for the media only - and to my knowlege has not been
reported by any news organization yet - said, "
If you've got an opinion
about the proposed change, call the Lottery at 1-800-37-LOTTO
."

The TLC reports that so far, approx 40% of the callers have been in favor
of this change. They are
not taking names, addresses, phone numbers -
they are just reporting how many are "for" and how many are "opposed."

This is
not posted on their web site. I suggest you go on and call the
TLC but we will still have to do written comments. More coming
on the written comments.

So, go ahead - Call 1-800-375-6886 and tell 'em
if you are "for" or "against" the changes. It's FREE!
(When you call, don't pick any of the recorded options -
just wait and customer service will eventually answer.)


1st - Watch this page regularly for updates.

2nd - Effective 2-3-03 - Quit buying lotto tickets NOW.
Start speaking with your dollars by keeping them in your pocket.
Do
not support the TLC so long as you know the sole intent of changing
Lotto Texas is to make more money for the state at the expense of the people.

Their plan is to offer us a game that we probably won't win -can't win -
so they can entice players to spend excessively by using big jackpots as bait.
Understand, the only way the TLC can get those huge jackpots is
by insuring that players probably won't win so as to allow the pots to roll.

Many thanks to those of you who have already written that you will refrain
from buying. The overall plan is to halt Lotto Texas sales within the next 30 days.

3rd - Effective 2-4-03 - Besides item number 2 which was to stop playing Lotto Texas now,
I need a guaranteed 50 people right now from Dallas, 50 people from Houston,
50 from San Antonio, 50 from Austin, 50 from Ft. Worth, and 50 from Corpus Christi
who are willing to meet for one hour in one location on one given day sometime
in the next 45 days. We will meet after work so it won't interfere with your work.

IF you oppose this rule change, then show your support
by committing yourself to the cause. If
YOU don't - then WE don't stand a chance.

Attention volunteers
: Many of you have already offered to do whatever is
necessary to help me help us all. Here is our first task. I cannot do this without
help from the people of Texas and I must have at least 50 people from each area.
And the more the merrier .... Hundreds would be fantastic!

do nots for commenting which I do
not plan to do right now - for a VERY good reason.
Your comments MUST address ONLY the issue at hand and the ONLY issue is
the TLC's motive which is to increase the odds so players can't or won't win,
thus, the state will make more money at our expense.

And while you may "think" their plan won't work, you are dead wrong. You see, they
don't care how long it takes the jackpots to build - because they know it will eventually
reach $50 million, and sales for one $50M drawing (that probably won't be won either)
will make up for lower sales on all the other draws leading up to the big jackpot. Then
the next drawing, at say $85 million, will give them the "average sales increase"
that they are looking for - all in a 7 day period. And if they are lucky enough
to have the jackpot roll again to over $120 million, well, let me tell you, too many
people will spend their rent money buying those tickets - all for a dream - and all but
one or two will wake up with a financial hangover - as the temptation was just too great.

The TLC is looking to increase revenues for Lotto Texas "overall" - not by
the draw. And I can assure you that when they take in $71 million in just 7 days,
compared to $8 to $11 million in 7 days, that in itself makes their plan successful.
Especially if they can do this 3 times per year which is what this plan will do.

For the record, I don't begrudge them for making this kind of money so long as the
rolls come "naturally" - but offering a game with odds of 47 million-to-one - when
the population is just 21 million - and only 53% of that population plays -
then this is nothing more than a scam. Somehow, they must be stopped
and its up to YOU to do it. I will do my best to advise you correctly.

The written comments are extremely important and we must have them - but this time,
we need to make sure that you say the right thing and send it to those in power.
I do NOT want to give "legal" (Kim Kiplin) the opportunity to twist
your comments
like they've done in the past. That's why it is so very
important that you comment in the manner to which I plan to spell out for you.

5th - Petitions to gather signatures is forthcoming too. But again, this will come
AFTER I do one very important thing first which has not been done because
of the recent NASA tragedy. I plan to make my first important move on 2-6-03.
